ZONING BOARD OF APPEALS PUBLIC HEARING – July 26, 2018

NOTICE IS HEREBY given that a Public Hearing will be held before the Zoning Board of Appeals on Thursday, July 26, 2018 at 6:00 P.M., in the Incorporated Village of Freeport, Main Conference Room, 46 N. Ocean Avenue, Freeport, New York, on the appeals and applications of cases as they appear on the calendar; residential applications that do not extend their prior non-conforming status may be called first; public comment invited. It is anticipated that the Board will adjourn the legislative session and enter into Executive Session until 6:30P.M.

INTERESTED PROPERTY OWNERS and other persons should appear at the above time and place to have questions answered and to voice opinions.

All applications are non-conforming with zoning regulations herein specified for the districts in which they are located.

Application #50-2017 – 50 C S. Main St., Business B – Section 55/Block 481/Lot 4 – Michelman Real Estate  – Interior alteration to add new stair to cellar, demo some existing partitions and construct new to enclose existing kitchen and enlarge the dining room. Village Ordinance §210-6A, §210-172(3)(4) sufficient parking is not provided in proposed application. Application shows zero (0) spaces seventeen (17) are needed.

Application #12-2018 – 36 Cedar St., Residence A – Section 62/Block 170/Lot 13 – Alin Michel  – One (1) Story Addition. Village Ordinance §210-6A, §210-41 Lot coverage shall not exceed 30% of the lot area.  Application shows 35% lot coverage.

Application #15-2018 – 348 North Long Beach Ave., Residence AA – Section 55/Block 392/Lot 198 – Terrence Chalmers  – Extend existing garage 3 feet out, with new roof over garage. Village Ordinance §210-6A, §210-35A(1) Required Yards.  Front yard depth minimum 20 feet.  Application indicates front yard depth of 16.65 ft.

Application #9-2018 – 34 Irving Ave., Residence A – Section 54/Block 336/Lot 64 – Yuval Aroety – Code Compliance-split property, Parcel 1. Village Ordinance §210-6A, §210-40 Lot Area, street frontage. No building shall be erected on a lot whose area is less than 5,000 sq ft.  Application indicates lot size of 4,800 sq ft.

Application #10-2018 – 34 Irving Ave., Residence A – Section 54/Block 336/Lot 64 – Yuval Aroety – Code Compliance-split property, Parcel 2. Village Ordinance §210-6A, §210-40 Lot Area, street frontage. No building shall be erected on a lot whose area is less than 5,000 sq ft.  Application indicates lot size of 4,800 sq ft.

Application #16-2018 – 222 Sportsmans Ave., Residence A – Section 62/Block 088/Lot 35 – Michael Benji  – Proposed new 2 story 1,249 sq ft 3 bedroom house. Village Ordinance §210-6A, §210-39 Sky Exposure Plane. Proposed plans indicate interference with front and rear sky exposure plane. §210-40 Lot Area. No building shall be erected on a lot whose area is less than 5,000 sq ft. Application indicates lot size of 2,500 sq ft. §210-43A(1) Required Yards. Front yard depth; minimum 20 ft. Application indicates 7 ft 6 in. §210-43(2) Rear Yard Depth, minimum 20’.  Application indicates a rear yard depth of 16 ft 11 in.

Application #53-2017 – 178 Sportsmans Ave., Residence A – Section 62/Block 088/Lot 22 – Erich Jung Reconstruct single family dwelling thru NY Rising 999 sq. ft. Village Ordinance §210-6A, §210-39 Sky Exposure Plane. Proposed plans penetrate the front and rear sky exposure planes. §210-40 Lot area; street frontage: lot width. No building shall be constructed on a lot with an area less than 5,000 sq ft or street frontage less than 50 sq ft. Application indicates lot size of 1,000 sq ft and street frontage of 20 ft. §210-41 Lot coverage may not exceed 30%. Proposed lot coverage is 65%. §210-43A(1)(2)(3)(4) Required Yards. Front, rear and side yard minimums of 20 ft, 20 ft, and 5 ft respectively. Application shows respectively 9.9 ft, 9 ft. 3.25 in, and side yards of 1.6 ft and 2 ft. Separation from dwelling on adjacent lots: minimum separation of 15 ft.

Application #36-2017 – 180 Sportsmans Ave., Residence A – Section 62/Block 88/Lot 27 – Robert Moulton Proposed 3 story one family residence with 2 car garage and rear balconies. Village Ordinance §210-6A, §210-39B(1),(2). Sky Exposure Plane.  Proposed plans penetrate sky exposure plane on front and side property lines. §210-40 Lot area. No building shall be constructed on a lot with a lot size less than 5,000 sq ft. Application shows 2,650 sq ft. §210-41 Lot Coverage: Floor Area Ratio, Porch lot coverage: may not exceed 30% with an additional 10% permitted for detached garage, 5% for an enclosed porch.  Proposed lot coverage is 32.6%, Floor Area Ratio is 69% and Porch Lot Coverage is 48%. §210-43A(1) Front Yard depth, minimum 20 feet.  Application indicates front yard of 10’-10”. §210-43A(2) Rear yard depth; minimum 20’. Application indicates a rear yard depth of 13’. §210-43C(4) Separation from dwelling on adjacent lots; minimum separation of 15’ shall be provided from any existing dwelling on adjacent lots.  Application indicates 7’-4” on north side and 10’-8” on south side.

Application #6-2018 – 395 Woodcleft Ave., Marine Commerce – Section 62/Block 177/Lot 520 – Michael Danon Construct a catering facility on the 2nd floor, extend the existing 1st floor bar, enclose the rear patio area on the 1st floor for interior seating and rooftop seating. Village Ordinance §210-6A, §210-239 Building Height. No building or structure shall exceed 40 ft in height.  Application indicates a 3rd floor storage room making the proposed structure approximately 51 ft tall. §210-242 Vehicular access for loading and unloading.  Application does not show said loading area as required. §210-172(4) Required parking.  Restaurants, discotheques, cabarets and bars; at least one (1) parking space for every 3 authorized occupants.  Application indicates total occupancy increase of 828 persons.  This occupancy would require 276 parking spaces.  This application needs a variance for an additional 240 parking spaces.
